vendors, business prospects, end-users, employees, applicants, search subjects,
and consumers.
Checkers gathers information
about its clients, vendors, business prospects, end-users, employees,
applicants, search subjects, and consumers primarily to process services
related orders, but also to continue to provide superior and personalized
customer service. ?By collecting the information, Checkers is able to make more
accurate recommendations, promptly answer questions from each of these parties
about their own circumstances, and send email notices or reminders. Checkers is
dedicated to providing the best possible experience to all parties and
gathering this information helps make that possible.

Checkers and services owned and operated by Checkers. Please carefully read our
privacy policy to understand how we will treat the information you provide and
our service. It also describes the choices available to you regarding the use
of, your access to, and how to update and correct your personal information.

use our services for the most current information. The use of information
collected through our service shall be limited to the purpose of providing the
service for which the Client has engaged Checkers.
Collection and Use of
Information
Information You Provide
We do not collect any personally
identifiable information about you unless you provide it to us voluntarily
and/or authorize this as part of Checkers’ services, such as your undergoing a
background check. It is your decision whether to continue with any
activity that requests or collects your personal information.
Accordingly, there may be times when you provide us with personal information,
such as your e-mail address, name, address or phone number by contacting
Checkers. This information is used to respond to your inquiries in the ordinary
course of business.
We do not collect personally
identifiable information about you by automated means, such as by using cookies
or web beacons. We will not sell, lease, license, trade or otherwise
transfer your personal information to third parties except in specific
instances already authorized by you – primarily when you authorize undergoing a
background check conducted by Checkers. There are limited circumstances
when we may share information that you submit online with third parties as
described in this policy and documentation you are provided with. When you
submit your personally identifiable information (e.g., name, address, telephone
number and email address) by contacting Checkers, you are giving your consent
to the collection, use and disclosure of information as set forth in this
policy.
When you provide information to
Checkers, whether electronically, online, over the phone, via mail, in-person,
or via any other means, we use it only for the business transaction for which
it was collected. Based on the nature of your transaction with us, you may
provide to us certain personal information such as first and last name; home
address, or other physical address; an email address; a telephone number; a
social security number; or certain other information, such as date of birth,
employment information, schools attended, licenses held and other information
as required to process your transaction (collectively, “Personal Information”).
In general, we will use the information collected from you for the purpose for
which you provided such information. We will not release your Personal Information
to third parties except as necessary for us to process your transaction and/or
as specifically authorized by you.
Information Sharing
We will share your Personal
Information with third parties only in the ways that are described in this
policy. We do not sell your Personal Information to third parties. We may
provide your Personal Information to companies that provide services to help us
with our business activities such as criminal searches and employment
verification, which is to facilitate the transaction that has already been
specifically authorized by you. These third party companies are authorized to
use your personal information only as necessary to provide these services to
us. We may also disclose your personal information as and if required by law,
such as to comply with a subpoena, or similar legal process when we believe in
good faith that disclosure is necessary to protect our rights, protect your
safety or the safety of others, investigate fraud, or respond to a government
request. If Checkers is involved in a merger, acquisition, or sale of all or a
portion of its assets, you will be notified via email and/or a prominent notice
on our website of any change in ownership or uses of your personal information,
as well as any choices you may have regarding your personal information, to any
other third party with your prior consent to do so.
User Access and Choice
If your personal information
changes, you may correct, update, amend or delete/remove it by contacting us by

respond to your request to access within 30 days. Checkers will retain your
information for as long as needed to provide our services and/or required by
law. We will retain and use your information as necessary to comply with our
legal obligations, resolve disputes, and enforce our agreements.
Protection of Your Information
We maintain physical, electronic,
and procedural safeguards to guard the Personal Information you provide to us.
Our products and/or services online are transmitted through secure, encrypted
transmission. Further, we have security policies and procedures in place to
protect the Personal Information we maintain about you from unauthorized access
or alteration. These measures include internal and external firewalls, physical
security and technological security measures, and encryption of certain
information (including login credentials). No method of transmission over the
Internet, or method of electronic storage, is 100% secure, however. Therefore,

Regarding Children
We define children as individuals
under the age of 18. Our electronic and online services are not intended for
the use of children and we do not intend to collect information about children
through electronic means.
Personal Information
Disclosure: United States or Overseas
Personal Information submitted to
Checkers for a background screening investigation may at times be transferred
outside of the United States in order to perform the background investigation
specifically when Checkers is attempting to verify your credentials or history
during times you were in another country outside of the United States. All
personal information will be transmitted and stored in a secure manner in
accordance with the terms of this Privacy Policy and any and all applicable
laws.
Links to 3rd Party Sites
Our services may entail links to
other websites whose privacy practices may differ from those of Checkers. If
you submit personal information to any of those sites, your information is
governed by their privacy policies. We encourage you to carefully read the
privacy policy of any website you visit.
Changes to This Policy
Checkers may revise or update
this privacy policy on occasion to reflect changes to our practices. If we make
any material changes we will provide notification through the Company’s Web
Site prior to the change taking effect. You should refer back to this page for
the latest information and the effective date of any changes.
Information Related to Data
Collected through Checkers’ Services
Checkers collects information under
the direction of its Clients, and has no direct relationship with the
individuals whose personal data it processes.
Choice
We collect information for our
Clients, if you are affiliated with of one of our Clients and would no longer
like to be contacted by one of our Clients that use our service, please contact
the Client that you interact with directly.
Service Provider,
Sub-Processors/Onward Transfer
Checkers may transfer personal
information to companies that help us provide our service. Transfers to
subsequent third parties are covered by the provisions in this Policy regarding
notice and choice and the service agreements with our Clients.
Access to Data Controlled by
our Clients
Checkers has no direct
relationship with the individuals whose personal data it processes. An
individual who seeks access, or who seeks to correct, amend, or delete
inaccurate data should direct his query to the Checkers’ Client (the data
controller). If the Client requests Checkers to remove the data, we will
respond to their request within 30 business days
Data Retention
Checkers will retain personal
data we process on behalf of our Clients for as long as needed to provide
services to our Client and/or required by applicable law. Checkers will retain
and use this personal information as necessary to comply with our legal
obligations, resolve disputes, and enforce our agreements.

Contractual Relationship
Information
Checkers may use the personal
information of business prospects, clients and vendors in order to establish,
execute and terminate a contract. ?Business prospects can be contacted during
the contract preparation process using the information that they have provided.
?Personal data can be processed to prepare bids or to fulfill other requests of
the prospect that relate to contract conclusion. ?This includes notices and
advisory services for the client under the contract if this is related to the
contractual purpose. ?
To ensure that subject
information is safeguarded, personal information may be used to complete due
diligence checks to ensure that subject data is only provided to third parties
that have been appropriately verified and credentialed.
Advertising Information
Checkers does not create,
maintain, or sell mailing lists or exchange services in return for the use of
personal information. ?Clients, vendors and business prospects may receive
periodic mailings or emailings from Checkers with information on Checkers
services. To opt-out, contact Checkers in writing or by email at the addresses

Checkers does not sell or
advertise the personal information of job applicants, employees or data report
subjects.
Employee and Applicant Information
Checkers may collect information
from employees, independent contractors, and job applicants to perform its
human resource functions. ?Individuals will be informed of the purposes for
which Checkers collects and uses the personal information. ? Checkers will
provide the Individual with the choice and means, if any, for limiting the use
and disclosure of their personal information when required. ?Disclosures or
notices will be provided in clear and conspicuous language when individuals are
first asked to provide personal information to Checkers, or as soon as
practicable thereafter, and in any event before Checkers uses or discloses the
information for a purpose other than for which it was originally collected.
Consumer Information
Checkers may disclose personal

transaction and purpose for which it was collected. ?Third party disclosure of
the personal information may include the requesting client company, affiliate
companies, third party agents, in-country sources, educational institutions,
employers, courts, law enforcement agencies and other persons, businesses or
government agencies as necessary for Checkers to complete a business
transaction.

European Union, European
Economic Area, United Kingdom and Switzerland Privacy Policy
Checkers International, Inc.
("Checkers") follows the legal framework of EU approved standard
contractual clauses with respect to personal information collected from
individuals who reside in the European Union. ?Checkers complies with and
adheres to the Regulation (EU) 2016/679 of the European Parliament and of the
Council of 27 April 2016 on the protection of natural persons with regard to
the processing of personal data and on the free movement of such data and repealing
Directive 95/46/EC (General Data Protection Regulation) with regard to the
processing of personal data and on the free movement of the data. ? Checkers
also complies with and adheres to the EU Commission Decision on standard
contractual clauses for the transfer of personal data to processors established
in third countries under the Regulation (EU) 2016/679 of the European
Parliament and of the Council of 27 April 2016 on the protection of natural
persons with regard to the processing of personal data and on the free movement
of such data and repealing Directive 95/46/EC (General Data Protection

Checkers collects and uses the
personal information of clients, vendors, business prospects, employees, job
applicants and consumers. The information obtained by Checkers will be used for
the purpose for which it was collected or for legal requirements.
Consumer Information
Checkers receives information on
consumers from its clients, vendors or other entities (courts, law enforcement
agencies, educational institutions, employers, etc.) within the EU, EEA, United
Kingdom or Switzerland in the performance of services for and under the
direction of its clients. ?Where Checkers is the recipient of personal
information, it will use the information in accordance with the purpose
indicated with the notices provided by such entities and the consent choices
made by the individuals to whom such personal information relates. ? Checkers’
client types include employers, financial institutions, insurance companies,
other background screening agencies, etc. ?Most services are requested for the
purposes of employment related decisions, credit granting and license
applications. ? Checkers plays no part in making any decision related to how
our clients use the consumer information Checkers provides in the performance
of the services ordered.
Client, Business Prospect
& Vendor Information
Checkers collects and uses the
personal information of clients to process orders. ? Checkers may use the
personal information of business prospects, clients and vendors in order to
establish, execute and terminate a contract. ?Business prospects can be contacted
during the contract preparation process using the information that they have
provided. ?Personal data can be processed to prepare bids or to fulfill other
requests of the prospect that relate to contract conclusion. ?This includes
notices and advisory services for the client under the contract if this is
related to the contractual purpose. Personal information may be provided to
financial institutions to process payments. ?To ensure that subject information
is safeguarded, personal information may be used to complete due diligence
checks to ensure that subject data is only provided to third parties that have
been appropriately verified and credentialed.
Choice
Checkers affords individuals the
opportunity to choose whether their personal information will be disclosed to a
third party or will be used for a purpose incompatible with the purpose for
which it was originally collected or subsequently authorized by the individual.
?Therefore, consumer data may be disseminated under these circumstances unless
the consumer explicitly opts-out by withdrawing consent.
Where a consumer chooses to
withdraw consent, processing will be stopped without undue delay. ?When a
consent is withdrawn, information is not necessarily erased or deleted. ?The
consumer shall have the right to request erasure. ?Various laws may require
that the data be maintained on file for a specified period of time for consumer
protection purposes.
Accountability For Onward
Transfer
Checkers discloses personal data
that it collects to third parties in connection with the business transaction
for which it was collected. ?Third party disclosure of the information may
include the Checkers’ client whom the consumer has authorized to receive such
information and the third-party representative of Checkers authorized to
receive such information (e.g. affiliate companies, agents, in-country sources,
educational institutions, employers, courts, law enforcement agencies and other
persons or entities that may provide or verify information as necessary for
Checkers to process the authorized transaction). ? Checkers also may in good
faith disclose personal information and any other additional information
available to Checkers, for any of the following purposes: (i) to investigate,
prevent or take action regarding actual or suspected illegal activities or
fraud; situations involving potential threats to the physical safety of any
person; or violations of Checkers’ terms of use; (ii) to respond to subpoenas,
court orders, or other legal process; (iii) to establish or exercise Checkers’
legal rights; or (iv) otherwise to comply with applicable law. ?
Security
Checkers is committed to
protecting personal information. ?While Checkers cannot guarantee the security
of the information, Checkers utilizes a combination of online and offline
security technologies, procedures and organizational measures to help safeguard
consumer information against loss, misuse and unauthorized access, disclosure,
alteration and destruction.
Data Integrity and Purpose

law, Checkers takes reasonable steps to ensure that the information Checkers
collects is accurate, complete, current and reliable for its intended use. ?
Checkers only collects data that is necessary for the purposes listed under the

Checkers takes reasonable and
appropriate measures to retain personal data only for as long as Checkers has a
legitimate legal or business need, such as compliance with legal or contractual
retention obligations, retention for audit purposes, customer service, security
and fraud prevention, preservation of legal rights or other reasonable purposes

Checkers cannot guarantee, however, that third parties are accurate in their
information. ?Therefore, Checkers denies any responsibility for the accuracy of
the data supplied by any third-party sources of information or by Checkers
clients.
Access
An individual may request, in
writing, the personal information collected and maintained. ?In the case of
consumers, this includes a copy of their consumer report.
Checkers affords the consumer a
reasonable opportunity to correct, amend or delete information that is
inaccurate or incomplete, except where the burden or expense of providing
access would be disproportionate to the risks to the individual's privacy or
where the rights of persons other than the individual would be violated. ?Individuals

verification of the consumer's identity.
